This program contains a short court hearing and an interview with Benzie County's sheriff. Marijuana possession charges filed against a long-time Benzie County commissioner were dismissed on Monday, August 30, as part of a plea bargain. Mary Pitcher pleaded guilty to having an open container of beer in her vehicle when it was pulled over in June. She was sentenced to pay a minimal fine. Prosecutors also dropped a charge that alleged Pitcher knowingly allowed an unlicensed person to drive her vehicle. Pitcher claims that she wasn’t aware that there was marijuana in her car and she had no idea that the person driving her vehicle had a suspended license. After her sentencing hearing, Benzie County Sheriff Rory Heckman became visibly upset with what he described as the special treatment that Commissioner Pitcher received. He says that his officer saw Pitcher attempt to conceal the marijuana during the stop and they also had witnesses come forward who alleged she absolutely knew the driver didn’t have a license. Pitcher doesn’t dispute that she handled the marijuana, but says the police report contained inaccurate statements regarding any attempt by her to hide it from the officer. At the time of her arrest, Pitcher was running unopposed in this November's general election. Shortly after she was charged, two candidates filed to run against her as independents.

This program is an August 26 hearing in Wayne County Circuit Court regarding the City of Detroit's Election Commission rejecting a November ballot initiative that, if passed, would have prevented adults from being prosecuted by the city for possessing less than 1 ounce of marijuana. The Coalition for a Safer Detroit led the ballot petition drive and filed suit to force this issue on the ballot. Circuit Judge Michael F. Sapala declined to force the city to put it on the November ballot. The Coalition for a Safer Detroit says they will likely appeal his ruling.

The following footage is a pretrial ruling that occurred immediately prior to jury selection. Kalkaska County Circuit Court Judge Janet M. Allen rules in chambers that Kiel's attorney cannot argue to the jury, or discuss any information, regarding the affirmative defense section of Michigan's Medical Marihuana Act.
